Technology to provide check on Supreme Court justices

The Supreme Court has announced the adoption of newly developed technology designed to assist in the screening process for potential conflicts of interest among the justices. This move formalizes and modernizes a practice that was previously managed manually by the justices and their staffs.

The software will be used to systematically review the justices’ financial disclosure reports and other records, cross-referencing them with case filings before the Court. Its primary function is to flag any possible overlaps, such as stock ownership in a company involved in litigation, that could necessitate a justice’s recusal from a particular matter.

Officials emphasized that the technology serves as an aid, not an arbiter. The final decision on whether to step aside from a case will remain a personal and judicial responsibility for each individual justice. The implementation of this tool is framed as an enhancement to the Court’s existing ethics procedures, aiming to bolster public confidence by adding a layer of technological rigor to the conflict-checking process. The development follows ongoing public and congressional scrutiny regarding the Court’s internal ethics guidelines and how recusal decisions are made.
